Terms and conditions of sale
These terms and conditions apply to quote requests made on SolarGear.eu and to the sales that follow from them.
1Who we are
SolarGear.eu is a catalogue of photovoltaic and energy storage products from third-party brands, where customers can request quotes. It is run by Litio Store SRL, Via Giotto 2, 06028 Sigillo (PG), Italy, VAT number and tax code IT03894170541, email info@litio.store. The site is not an online shop: there is no checkout and no purchase is concluded on this site.
2Scope
These terms apply to consumers (natural persons acting for purposes outside their trade, business, craft or profession) and to businesses, professionals and VAT-registered customers. Where a rule applies only to consumers, this is stated. Special conditions agreed in writing for B2B supplies, projects or custom orders prevail over these terms for the matters expressly agreed.
3Catalogue and quote requests
Product pages, specifications and prices on the site are for information and are an invitation to request a quote. Sending a quote request is free and does not commit the customer. We reply by email with a written quote stating the products, quantities, final price including delivery, the delivery time and how long the quote is valid.
4Conclusion of the contract
The contract is concluded when the customer accepts the quote in writing and Litio Store SRL confirms the order by sending a pro forma invoice or a payment link. We may decline a request, for example if a product is no longer available, in the event of an obvious error in price or description, or if the billing or delivery details are incomplete or cannot be verified.
5Prices, VAT and invoicing
Prices are in euros. Prices shown on the site are indicative, exclude VAT and delivery, and are the same as on litio.store. The binding price is the one stated in the quote, which includes delivery to the address given. VAT: EU businesses with a valid VAT number checked on VIES are invoiced at 0% (intra-community reverse charge); Italian businesses and private customers in Italy pay Italian VAT at 22%; private customers in other EU countries pay the VAT rate of their country (OSS scheme). Products ship from warehouses in Italy and the EU, so there are no import customs formalities for deliveries within the EU. For deliveries outside the EU, import duties, local taxes and customs fees are paid by the customer on arrival under local rules. Italian businesses must provide an SDI code or PEC address for electronic invoicing. Billing details cannot be changed once the invoice has been issued.
6Payment
Payment is made by bank transfer against the pro forma invoice, within the term stated on it, or by card through a payment link on litio.store. The goods are shipped once payment has been received.
7Delivery times
The delivery time is stated in the quote and runs from receipt of payment. Delivery times are estimates: we inform the customer of any significant delay, and if the delay is not acceptable the customer may cancel the order and receive a refund for the part not delivered. For consumers, unless another term has been agreed, delivery takes place within the maximum period set by law.
8Shipping and transfer of risk
Small items travel by courier; batteries, inverters and solar panels may travel on pallets by freight forwarder. Lithium and sodium batteries are dangerous goods for transport: they are packed and declared under the applicable rules (ADR) and shipped only with authorised carriers. For consumers, risk passes when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods. For business customers, unless otherwise agreed in writing, risk passes when the goods are handed over to the carrier. On delivery, check the packaging and the number of parcels or pallets: if anything is damaged, wet, opened or tampered with, accept it subject to a specific written reservation on the carrier's delivery note and report it to info@litio.store with clear photos as soon as possible. Signing without reservation makes it harder to hold the carrier liable.
9Genuine products
Every product we supply is new, original and from the manufacturer stated in the quote, and comes with the manufacturer's warranty.
10Legal guarantee and manufacturer's warranty
Consumers: the 24-month legal guarantee of conformity from delivery applies (Italian Consumer Code, Legislative Decree 206/2005, Articles 128 et seq.), without prejudice to any more favourable mandatory rules of the consumer's country. In the event of a lack of conformity the consumer is entitled to repair or replacement and, where provided by law, to a price reduction or termination of the contract. Business customers: the warranty against defects under the Italian Civil Code (Articles 1490 et seq.) applies for 12 months from delivery; defects must be reported in writing within 8 days of discovery, or the right is lost. The legal guarantee is given by the seller. The manufacturer's warranty is in addition to it and does not limit legal rights; claims under it are handled through us, so customers do not need to contact the manufacturer directly.
11Making a warranty claim
Write to info@litio.store with the order reference, the exact model and serial number, a description of the problem, the operating conditions and the connected components, with clear photos of the labels and, if available, the system diagram. Do not send products to us or to the manufacturer before we have confirmed the procedure.
12What the guarantee does not cover
Defects caused by installation not carried out according to the manufacturer's instructions or by unqualified persons; incorrect system sizing; series or parallel connections not allowed by the manufacturer; use outside the stated voltage, current, power and temperature limits; overload, short circuit, reverse polarity, prolonged deep discharge or long periods without charging; unauthorised opening, repairs or modifications; transport damage not reported as described above; normal wear and the natural loss of battery capacity due to cycling, ageing and operating conditions.
13Right of withdrawal
Consumers may withdraw from the contract within 14 days of delivery without giving any reason. The right of withdrawal does not apply to businesses, professionals or VAT-registered customers. How to withdraw, the required condition of the goods and the return address are set out on the Returns and right of withdrawal page, which forms part of these terms.
14Installation and use of the products
Inverters, storage batteries, solar panels, charge controllers, chargers and the other products in the catalogue are electrical and electrochemical equipment. They must be installed, connected and commissioned by qualified electricians, following the manufacturer's instructions and in compliance with the technical and safety standards, building and electrical regulations and grid codes that apply where they are installed, including the requirements of the local distribution system operator for grid connection. Permits, grid connection notifications, certificates of conformity and eligibility for incentives are the responsibility of the customer and the installer.
15Information on the site and liability
Information on the site, including specification tables, comparisons, compatibility notes and example configurations, comes from the manufacturers' datasheets and is for guidance only. It is not a system design or a conformity check and does not replace the manufacturer's current documentation or professional advice. The choice of products, the sizing of the system and compatibility with existing equipment remain the responsibility of the customer and their installer. To the extent permitted by law, we are not liable for damage caused by incorrect installation, wiring, configuration or maintenance, by combination with incompatible components, by use outside the stated specifications, by failure to follow the safety, storage, charging and transport instructions, or by work carried out by unqualified persons. This does not limit liability for wilful misconduct or gross negligence, for personal injury, or under mandatory product liability and consumer protection rules.
16Force majeure
We are not liable for delays or failures caused by events that could not reasonably be foreseen or avoided, such as natural disasters, strikes, decisions of public authorities, interruptions to transport or supply, shortages of materials, or failures of third-party IT systems. In such cases, deadlines are suspended for the duration of the event and the customer is informed.
17Changes
We may update these terms to reflect changes in our offer, services or the law. The version published when the quote is accepted applies to that order. If any clause is held to be invalid, the remaining clauses stay in force.
18Applicable law and jurisdiction
These terms are governed by Italian law. Consumers keep the mandatory protection of the law of their country of residence in the EU; for consumers resident in Italy, the court of the consumer's place of residence or domicile has exclusive jurisdiction (Article 66-bis of the Italian Consumer Code). For business customers, the courts of the place where Litio Store SRL has its registered office have exclusive jurisdiction.
19Complaints and dispute resolution
Complaints can be sent to info@litio.store: we reply as quickly as possible and look for an agreed solution. Consumers may also use the alternative dispute resolution (ADR) bodies provided for by Articles 141 et seq. of the Italian Consumer Code and, for cross-border disputes within the EU, the European Consumer Centres Network (ECC-Net). The European Commission's online dispute resolution (ODR) platform has been closed; online disputes can be handled by the competent ADR bodies. Using these procedures is optional and does not affect the right to go to court.
